Indian High Courts issue rulings on income tax reassessment and penalty procedures

Recent judicial decisions from various Indian High Courts and the Supreme Court have clarified several aspects of income tax law and assessment procedures.

The Delhi High Court ruled that an Assessing Officer cannot issue a penalty order under Section 270A while the underlying assessment is still pending an appeal before the Income Tax Appellate Tribunal (ITAT). This decision follows Section 275(1)(a), which requires penalty proceedings to remain in abeyance during such appeals.

In a separate matter, the Delhi High Court held that if an Assessing Officer reschedules a cross-examination at a taxpayer's request, they cannot later use the taxpayer's initial absence as a reason to deny effective cross-examination or pass an assessment based on third-party material.

Additionally, a digest of case law from August to October 2026 highlights significant rulings regarding the constitutional validity of Section 147A, the jurisdiction of officers under faceless reassessment schemes, and the prohibition against reopening assessments based on a mere change of opinion. These rulings emphasize the necessity of a live nexus between information and alleged escaped income.
