Indian High Courts issue rulings on matrimonial cruelty and child welfare
The Allahabad High Court has ruled that persistent pressure from a wife on her husband to abandon his widowed mother constitutes mental cruelty. The court held that such behavior entitles the husband to a divorce decree under Section 13 of the Hindu Marriage Act, 1955, noting that attempting to deprive an elderly mother of her son's company in her twilight years is a cruel act.
In a separate ruling, the Madras High Court stated that spouses cannot be compelled to maintain an unworkable matrimonial relationship solely for the welfare of their children. The court observed that while child welfare is a critical consideration, forcing parents to live as strangers in a state of constant discord creates a broken emotional environment. The bench emphasized that a child requires a home built on mutual respect and cordiality rather than just material facilities and a shared roof.
