Indiana Governor Mike Braun settles lawsuit with former IURC Chair

Indiana Governor Mike Braun and former Indiana Utility Regulatory Commission (IURC) Chairman Andy Zay have reached a settlement in a lawsuit pending in Marion Superior Court. The legal dispute arose after Zay was removed from his position in early August. Zay had filed a complaint on August 10, alleging his removal was “unlawful.”

The state had previously cited several reasons for the dismissal, including allegations that Zay committed “multiple potential violations of state policy.” These included failing to file a required financial disclosure, improperly awarding payments and personal gifts to employees, and directing staff to alter a public meeting agenda without consulting the incoming Chair.

While the specific terms of the settlement agreement were not released, Governor Braun described the resolution as “mutual” and stated it allows all parties to “move forward constructively in the best interest of Hoosiers.” Zay expressed disappointment regarding his departure from the IURC but noted that he believes the resolution is in the best interest of the state.
