Indiana prosecutors decline charges in Tim Hortons death case

The Allen County Prosecutor's Office has announced that no criminal charges will be filed following the death of 75-year-old Anita Grayson during a physical altercation at a Tim Hortons in Fort Wayne, Indiana.

According to an investigative report involving security footage, 911 recordings, and witness statements, the incident occurred on May 13. Grayson had returned to the restaurant to dispute a drive-thru order, leading to a verbal confrontation with a 17-year-old employee. A second employee intervened to defend the minor, at which point the confrontation became physical. The report stated that "Grayson shoved and struck Employee 1, the two fell to the floor and continued struggling and coworkers separated them."

Surveillance footage confirmed that Grayson was the first to strike the employee. Following the altercation, Grayson was treated at the restaurant before being transported to a hospital, where she later died of an acute exacerbation of congestive heart failure. The prosecutor's office described the incident as a "heartbreaking situation for everyone involved."
