Indonesia Constitutional Court rejects health law challenge on outbreak response

The Constitutional Court (Mahkamah Konstitusi) delivered Decision No. 172/PUU‑XXIV/2026 on 29 June 2026, rejecting all material test requests filed by Dharma Pongrekun against Law No. 17 of 2023 on Health. The court held that the delegation of authority to the Minister of Health for setting technical criteria in handling Kejadian Luar Biasa (KLB) and outbreaks is permissible, and that provisions on mandatory compliance, reporting obligations and related criminal sanctions are constitutionally valid. The court said these rules serve as instruments for early warning and effective public‑health protection.

The Ministry of Health welcomed the ruling, stating it confirms the legality of the health law’s outbreak‑management measures and underscores the importance of public participation and rapid reporting in safeguarding community health.
