Indonesia President Joko Widodo's Diploma Case Sent to Administrative Court

Criminal law expert Professor Gayus Lumbuun explained that the dispute over President Joko Widodo's alleged fake diploma should be resolved by the Pengadilan Tata Usaha Negara (Administrative Court). He said the court can examine the administrative steps that produced the diploma, assess procedural and substantive defects, and determine whether the document complies with the law, rather than a criminal court which focuses on the act of forging or using false documents.

In a related development, Tifauzia Tyassuma, known as Dokter Tifa, achieved a procedural victory when the Jakarta East District Court dismissed the defamation and libel charges linked to the diploma allegations. The court ruled the indictment was vague and therefore null, halting the case, although prosecutors indicated they will refile the matter in the same court.

Both developments highlight the legal complexities surrounding the president's diploma controversy and the differing jurisdictions of Indonesia's courts.
