Indonesian Constitutional Court reviews Criminal Code authority over state loss calculations
The Indonesian Constitutional Court (MK) held a hearing to review the 2023 Criminal Code (KUHP), specifically focusing on the authority to calculate and determine state financial losses. The case was initiated by Leonardi, a former Ministry of Defense official facing corruption charges related to a satellite procurement project involving 306 billion IDR in alleged losses.
During the proceedings, the Indonesian National Police (Polri) and the Corruption Eradication Commission (KPK) presented differing views. Polri argued that while various agencies may perform technical audits, the final, constitutional authority to determine the amount of state loss must reside with the Audit Board (BPK).
Conversely, the KPK expressed concerns regarding the centralization of this authority. The commission warned that if only the BPK is empowered to both calculate and finalize state loss figures, it could infringe upon the constitutional rights of defendants by limiting their ability to present alternative evidence or defend themselves against corruption allegations.
