Indonesia's Constitutional Court bars data‑quota expiry

On 23 July 2026 the Mahkamah Konstitusi (Indonesia’s Constitutional Court) issued Decision No. 273/PUU‑XXIII/2025 prohibiting mobile operators from deleting unused internet data quota when a subscription period ends. The ruling requires providers to offer mechanisms such as rollover, accumulation, extension of validity, transfer, compensation or refund so that consumers can use the remaining quota until it is fully consumed without extra charges.

Implementation has stalled because the Ministry of Communication and Digital (Kominfo) has not yet issued the necessary technical regulation to define the rollover mechanism. Public‑policy analyst Trubus Rahardiansah noted that a ministerial decree is needed to give clear guidance to operators and protect both consumers and the telecom industry.

Indosat Ooredoo Hutchison and Telkomsel said they respect the court’s decision and are reviewing their systems. Indosat’s legal chief Reski Damayanti said the company already offers rollover options and will expand transparency and product choices. Telkomsel’s corporate communications head Abdullah Fahmi confirmed existing rollover packages and pledged further development of consumer‑protection services.
