Indonesia's Constitutional Court orders telecoms to keep unused data active

The Mahkamah Konstitusi (Constitutional Court) issued Decision No. 273/PUU‑XXIII/2025, declaring previous regulations that let prepaid data quotas expire as unconstitutional. The ruling obliges telecommunications operators to ensure that any remaining internet quota remains active and usable, either through rollover, extended active periods, compensation, refunds or other flexible options. Legal commentator Dendy Yuliyanto hailed the decision as a milestone for consumer protection, especially for millions of prepaid users in eastern Indonesia.

Following the judgment, existing rollover schemes offered by major carriers – Telkomsel’s SIMPATI packages, Indosat’s Freedom Combo, and XLSmart’s XL‑brand plans – are under renewed scrutiny as operators must align their offerings with the court’s mandate and provide clear, flexible choices to customers.
