Indonesia to revise Military Justice Law following Constitutional Court ruling
The Indonesian government and Parliament are preparing to revise the 1997 Military Justice Law following a Constitutional Court (MK) ruling. The court declared the existing law unconstitutional in a conditional sense, mandating changes within two years to ensure it aligns with the 1945 Constitution.
Members of Commission I of the House of Representatives (DPR), including Dave Laksono and Nurul Arifin, emphasized that the revision is necessary to clarify the boundaries between military and general criminal offenses. The goal is to strengthen accountability and ensure that military personnel who commit general crimes are subject to the civilian judicial system, upholding the principle of equality before the law.
Minister of Law Supratman Andi Agtas has instructed the Directorate General of Legislation to conduct a comprehensive legal analysis of the court's decision. The Indonesian National Armed Forces (TNI) has expressed its commitment to complying with the ruling. The revision process is expected to be coordinated between the Ministry of Defense, the Ministry of Law, and the DPR to ensure legal certainty and professionalism within the military.
