Indonesia passes new Labor Protection and Satu Data Indonesia laws

The Indonesian House of Representatives (DPR) has passed two significant pieces of legislation: the Labor Protection Law and the Satu Data Indonesia (SDI) Law.

The Labor Protection Law, enacted following a Constitutional Court mandate to separate labor regulations from the Job Creation Law, introduces several key changes. It eliminates the 0.5 multiplier for severance pay, establishing a minimum of one multiplier. To ensure compliance, the law introduces a severance pay reserve fund. Other provisions include a two-year limit on fixed-term employment contracts (PKWT), restrictions on outsourcing to five specific service sectors, and a prohibition on companies withholding employees' personal documents or diplomas. The law also strengthens protections for women, including maternity and reproductive rights, and for workers with disabilities.

Separately, the Satu Data Indonesia Law establishes a framework for national data governance. The law regulates the use of artificial intelligence and blockchain, sets standards for data interoperability, and creates a national data catalogue. It also mandates that access to or transfers of closed data outside Indonesian jurisdiction require parliamentary approval. The law aims to ensure data is integrated, accurate, and sovereign to support strategic national needs such as social assistance distribution and fiscal policy.
