Inheritance law and asset succession in Italy

Under Italian civil law, individuals cannot legally compel an heir to leave specific assets to a third party in their own future will. Because property rights grant full autonomy to the owner, once an asset enters an heir's estate, that individual becomes the sole arbiter of its future disposition. To achieve similar practical results, legal strategies such as splitting ownership between usufruct and bare ownership may be utilized.

In cases where a vehicle is not explicitly mentioned in a will, it automatically becomes part of the hereditary estate according to the rules of legitimate succession. The vehicle is typically shared among heirs, such as spouses and children, in accordance with the hierarchy established by the Civil Code. This shared ownership requires mutual agreement for significant actions like sales or title transfers, though specific procedures exist through the PRA and the Highway Code to regularize the situation.
