Inheritance law: Rights of heirs and limitations of wills

Legal experts clarify common misconceptions regarding inheritance processes and the limitations of wills. In cases where a co-heir refuses to provide access to a will or necessary deeds, the process is not necessarily blocked. Individuals with inheritance rights can obtain a Certificate of Last Will Acts from the Ministry of Justice to identify the relevant notary and request an authorized copy directly.

Furthermore, legal frameworks such as the Civil Code dictate that a testator cannot distribute assets entirely at their discretion if there are forced heirs. Even if a will explicitly leaves everything to a surviving spouse, the rights of children or other mandatory heirs must be respected. Experts note that while a spouse may be granted usufruct rights, this does not equate to full ownership, and the law may override specific testamentary clauses to protect the rights of designated heirs.
