Inheritance planning is critical to prevent family disputes and asset loss

Effective inheritance and succession planning is essential to prevent economic disputes and the collapse of family assets. Experts suggest that failing to communicate about money or establish clear boundaries can transform emotional bonds into legal and financial conflicts.

In Ecuador, where 80% of companies are family-owned, the lack of preparation for succession poses a significant risk to substantial patrimony. Tax expert Ximena Amoroso notes that businesses may fail if heirs are unprepared or unwilling to manage the company. Successful wealth preservation often requires active planning, including establishing rules and holding difficult conversations before death.

Legal experts also emphasize that a will is not only for the wealthy; it covers various assets such as real estate, bank accounts, and investments. Without a will, the law determines the distribution of assets according to statutory succession rules, which may not align with the deceased's actual wishes. A will allows individuals to set specific conditions, designate particular beneficiaries, and provide clarity to avoid post-mortem decision-making conflicts.
