Inheritance processes and legal acceptance methods
Inheritance involves the transfer of a deceased person's assets, rights, and obligations to heirs. This process can occur through a will (testate inheritance) or via legal designation if no will exists (intestate inheritance).
Key steps in the process include obtaining a death certificate, verifying the existence of a will, deciding on the distribution of assets, and settling relevant taxes.
According to the Banco de España, heirs can accept an inheritance in two ways: ‘pure and simple’ or ‘to the benefit of the inventory’. In a pure and simple acceptance, heirs become responsible for the deceased's debts with both the inherited assets and their own personal assets. In an acceptance to the benefit of the inventory, heirs are only liable for the deceased's debts and charges up to the value of the inherited assets.
