INPS clarifies Naspi eligibility for victims of stalking and gender violence

The Italian National Social Security Institute (INPS) has clarified that workers forced to resign due to stalking or gender-based violence may be eligible for Naspi unemployment benefits. According to message 2540/2026, these protections apply even if the violence is committed by individuals unaffiliated with the employer, provided there is a concrete link between the abuse and the necessity to terminate employment to protect health, safety, or physical integrity.

Eligibility is not automatic. To access benefits through resignation for ‘just cause,’ applicants must provide documentation such as medical records, police reports, or legal measures that demonstrate the impact of the violence on their ability to continue working. This measure aims to prevent further economic hardship for victims who must leave their jobs to escape persecutory behavior.
