Inps reforms Italian sick leave rules to allow retroactive certification

Inps, in coordination with the Ministry of Labour, has introduced new rules regarding the effective date of sick leave certification in Italy. According to circular no. 92 issued on September 4, 2026, medical certificates can now be requested retroactively for the previous day.

This reform extends the ability to claim retroactivity to outpatient visits conducted at a general practitioner's office, whereas previously this was limited to home visits. For the certification to be valid for the preceding day, the physician must include a specific electronic declaration stating, ‘Dichiara di essere ammalato dal…’ followed by the correct date.

Strict limitations apply: the retroactivity is only valid for the single day immediately preceding the medical visit. If a doctor indicates a date more than 24 hours prior, the request will be denied. Furthermore, retroactivity cannot be applied if the preceding day is a Saturday, Sunday, or a weekday holiday; in such instances, workers must utilize continuity of care services.
