INPS updates sick leave and disability assistance rules in Italy
The Italian Social Security Institute (INPS) has introduced significant updates regarding sick leave and disability assistance regulations. Under Circular 92/2026, workers can now receive social security coverage for the day immediately preceding a medical visit, even for outpatient appointments, provided the doctor certifies the illness began on that previous day. This change aims to address difficulties caused by the shortage of general practitioners and increased workloads.
Regarding disability assistance under Law 104, INPS has clarified rules for shared leave. While multiple family members can now share the care of a person with a disability, the total monthly limit of three days remains fixed for the entire group. Exceeding this collective threshold can result in salary deductions. Additionally, a major reform scheduled for January 2027 will unify various disability assessments into a single procedure managed by INPS, though existing certifications will remain valid under the principle of legal consolidation.
Furthermore, workers assisting two different people with severe disabilities may be eligible to accumulate up to six days of leave per month. For those receiving civil disability benefits, INPS notes that a medical certificate alone does not guarantee financial assistance; additional criteria regarding income and loss of self-sufficiency must also be met.
