Insurance and liability for residential water damage

In the event of water damage within a residential property, determining liability and insurance coverage depends on the origin of the leak, the status of the occupants, and the specific terms of the insurance contracts.

For furnished rentals, tenants are legally required to hold insurance covering basic rental risks such as fire, water damage, and explosions. However, this minimum coverage often excludes damage to neighbors, personal belongings, or the landlord's furniture. A comprehensive multi-risk home insurance policy is typically required to cover civil liability and additional risks like theft or electrical damage.

When a leak affects multiple apartments, such as in a co-ownership building, the IRSI convention may simplify the settlement process between insurers for claims below certain amounts. Responsibility for repairs is determined by whether the leak originated from equipment maintained by the occupant, aging installations belonging to the landlord, or common pipes.
