Insurance and vehicle protection: legal distinctions and liability coverage

In Brazil, a distinction is being drawn between traditional vehicle insurance and vehicle protection associations. Traditional insurance is strictly regulated by the Superintendência de Seguros Privados (Susep) under the Ministry of Finance, requiring significant technical reserves to guarantee payouts and providing consumers with legal protection under the Consumer Defense Code. In contrast, vehicle protection associations operate on a mutual aid system governed by the Civil Code. Members of these associations are considered partners rather than consumers, meaning they lack the same regulatory safeguards. If an association lacks funds to cover a loss or becomes insolvent, members face significant legal challenges and may not be able to recover their losses.

Additionally, umbrella insurance is highlighted as a tool for managing civil liability risks. This type of coverage provides an extra layer of protection beyond standard home, auto, or boat policies, specifically for individuals facing potential lawsuits that exceed existing coverage limits. It is particularly relevant for property owners, pet owners, and families with teenage drivers, covering incidents such as property damage, bodily injury, defamation, or vandalism.
