International Criminal Court dismisses kidnapping petition against Nigeria

The International Criminal Court (ICC) has dismissed an anonymous petition seeking an investigation into alleged systemic kidnappings in Nigeria, categorizing them as crimes against humanity. The Pre-Trial Chamber II dismissed the application “in limine” — at the threshold — on September 1, 2026, citing a lack of legal basis and improper filing.

Nigeria’s Attorney-General of the Federation and Minister of Justice, Lateef Fagbemi, welcomed the dismissal but expressed serious concern regarding the ICC’s procedural handling of the matter. The government questioned why an unsigned and unverified submission from an “unknown submitter” was assigned to a chamber without a prior determination of its competence or validity.

Fagbemi stated that the initial processing of the anonymous communication represented an “unusual and troubling departure from the governing statutory framework of the Rome Statute” and could potentially undermine the integrity of the Court’s judicial processes. The Nigerian government maintained that its domestic legal systems are capable of investigating and prosecuting such allegations, adhering to the principle of complementarity.
