Iquique court orders $18.2 million CLP payment to Mall Zofri worker
A labor court in Iquique, Chile, has ordered Importadora y Exportadora Nuevo Amanecer Ltda to pay more than $18.2 million CLP to a former salesperson from Mall Zofri. The ruling validated the worker's constructive dismissal after nearly 14 years of service, citing repeated delays in salary payments and failure to pay social security contributions between August 2024 and September 2025.
Judge David Sepúlveda Cid ordered the payment to cover years of service, legal surcharges, notice period indemnification, pending wages, and vacation time. The court also ruled that the company must continue paying monthly wages until the dismissal is legally validated. The court dismissed the subsidiary responsibility of Zona Franca de Iquique S.A., concluding no subcontracting regime existed.
