Ireland launches Health Referral Scheme for drug possession

Ireland has launched the Health Referral Scheme, a pilot programme designed to provide a health-led response to drug use. Effective as of September 1, the scheme allows An Garda Síochána to refer eligible first-time offenders found in possession of small quantities of controlled drugs for personal use to health supports, rather than pursuing prosecution or an adult caution.

The initiative is a collaborative effort between the Department of Health, the Department of Justice, the Health Service Executive (HSE), and An Garda Síochána. It aims to encourage early engagement with services and reduce the long-term impact of first-time possession offences, allowing law enforcement to focus more on the sale and supply of illegal drugs.

To be eligible, individuals must have no previous convictions for drug use or prior adult cautions. A key requirement of the scheme is that the offender must admit to the possession of the controlled drug at the time of the offence and agree to participate in the referral process. Critics have noted that because the scheme is built into the existing Adult Caution Scheme, it still necessitates an admission of guilt to qualify for health intervention.
