Israeli military courts to review detention of 38 Palestinians

The Ofer military court is scheduled to hold sessions next Thursday to consider the confirmation of administrative detention for 38 Palestinian prisoners from the West Bank. Administrative detention allows Israeli authorities to hold individuals without formal charges or access to evidence, often based on classified files. According to the Palestinian Prisoners and Released Prisoners Commission, there are currently approximately 3,176 administrative detainees.

Separately, Israeli authorities have not yet established a timeline for the indictment of hundreds of Palestinians detained in connection with the October 7, 2023, attacks. Reports indicate that the recruitment of judges for specialized courts is expected to be completed by early 2027, with dedicated courtrooms planned for later that year.

The Israeli military prosecution is reportedly considering seeking the death penalty for certain defendants in these cases, a move expected to face challenges in the Israeli Supreme Court. This follows legislation passed by the Knesset that classifies actions related to the October 7 attacks as crimes against the Jewish people and crimes against humanity, providing a legal framework for such prosecutions.
