Turkey housing: Yargıtay rent ruling and TOKİ discount campaign

Turkey's legal and housing landscape is seeing significant shifts due to recent judicial rulings and government initiatives. The Supreme Court (Yargıtay) has issued a landmark decision regarding rent determination lawsuits. The court ruled that even if a lease agreement has been recently renewed, a landlord can file a lawsuit to adjust the rent if the current amount is significantly below market comparables, effectively bypassing the traditional 5-year waiting period requirement in certain circumstances.

In the housing sector, the Housing Development Administration of Turkey (TOKİ) has launched a campaign offering a 25 percent discount to approximately 228,000 property owners who pay off their remaining debts in full or make significant partial payments. This campaign is scheduled to run until October 19. Additionally, TOKİ is moving forward with a social rental housing project in Istanbul, with a lottery for 1,071 units expected to take place in October 2026.

Regarding inflation and rent adjustments, the official October rent increase rate, based on the 12-month average of the Consumer Price Index (TÜFE), is set to be announced by TÜİK on October 5.
