Italian administrative courts rule on student inclusion and evaluation rights

Italian administrative courts have issued rulings regarding student rights and educational inclusion.

The TAR Campania (Salerno section) granted a precautionary measure for a student with a disability in the province of Avellino. The court ruled that the school must provide a support teacher for the student's entire school hours rather than the eighteen hours per week previously assigned. The ruling challenges the sufficiency of teacher contingents allocated by the Ministry of Education and Merit.

In a separate case, TAR Puglia annulled the decision to deny a student admission to the next grade level following remedial exams. The judges ruled that the school failed to consider the student's overall academic performance and documented emotional fragility. The court emphasized that non-admission cannot be based solely on individual subject failures but must account for the student's complete educational path and personal circumstances.
