Italian Constitutional Court reviews prison condition legality

The Conference of Territorial Guarantors has been admitted as ‘amicus curiae’ to provide an opinion to the Italian Constitutional Court regarding the legality of mandatory imprisonment in inhumane conditions.

The case, originally raised by the Florence Surveillance Court following reports of degrading conditions at the Sollicciano prison, questions whether judges should have the authority to suspend sentences or order house arrest when prison environments fail to meet minimum standards of humanity. The legal challenge focuses on specific articles of the penal code and prison regulations that do not currently allow for such discretionary measures, potentially violating constitutional principles and the European Convention on Human Rights.
