Italian court annuls maritime concession fee increases for 2025

The Lazio Regional Administrative Court (TAR) has annulled a decree from the Ministry of Infrastructure and Transport regarding the update of maritime state property concession fees for 2025. The ruling follows an appeal by Assiterminal, the Italian association of port terminal operators, along with several logistics and port companies including Terminal Napoli, Psa Genova Prà, and La Spezia Container Terminal.

The court determined that the ministry lacked justification for deviating from established legal precedents. Previous rulings had identified that the fee updates were calculated using an illegitimate parameter contained in a decree that had already been definitively annulled by judicial decision. Consequently, the court has struck down the 2025 decree and its associated ministerial circular containing the updated fee tables.
