Italian Court Orders ASP Agrigento to Grant Temporary Hospital Transfer for Radiology Technician

The Tribunal of Gela ruled in favor of a radiology technician employed by the ASP of Caltanissetta who sought a temporary assignment to the San Giovanni di Dio hospital in Agrigento. The doctor, a mother of a child under three, lives in Raffadali and had been working at the Vittorio Emanuele hospital in Gela. She appealed an ASP Agrigento refusal that cited pending public‑service recruitment contests.

Citing article 42‑bis of Legislative Decree 151/2001, which guarantees parental proximity for public‑sector employees, the collegial court overturned the denial, ordered the immediate temporary transfer, and required the ASP to cover the associated expenses. The judgment highlighted the undue stress caused by daily two‑hour commutes and affirmed the constitutional right to protect the well‑being of the child and mother.
