Italian courts address condominium roof and fragrance disputes

A tribunal in Paola examined a dispute over multiple roof structures (tettoie) erected by a townhouse owner that allegedly obstructed a neighbour's view. Although the works had been approved by the municipality, the plaintiff argued they infringed on property rights and requested their removal. The court evaluated the balance between administrative authorisation and the protection of neighbours' visual and architectural rights.

In Treviso, a neighbour retaliated against complaints about a dog’s odor by repeatedly spraying a concentrated vanilla fragrance in common areas. The affected resident filed a criminal complaint for "olfactory nuisance" under article 674 of the penal code. The judge acquitted the accused of a criminal offense, noting that vanilla is not toxic, but issued an injunction prohibiting the use of sweet fragrances in the condominium and ordered the use of a milder pine scent to restore peace among residents.
