Italian courts clarify renovation vs. new construction rules
Italian courts have clarified the legal distinctions between building renovation and new construction, specifically regarding the demolition and reconstruction of existing structures. The Court of Cassation (sentenza n. 31912/2026) addressed the thin line between reconstructing a collapsed or demolished building and creating a new building from scratch. This distinction is critical because renovation status allows for simplified procedures via SCIA (Certified Notification of Commencement of Activity) and lower urbanization costs, whereas new construction requires a more complex building permit.
To qualify as a renovation, developers must precisely prove the pre-existing consistency and legal urban planning profile of the original building. A ruling from TAR Lombardia (sentenza n. 4033/2026) further emphasized that modifying the number of buildings or exceeding certain height parameters can reclassify an intervention as new construction. In such cases, an implementation plan (piano attuativo) may become mandatory to address the need for enhanced urbanization and infrastructure.
