Italian courts deny compensation claims in fall and dental malpractice cases

The Tribunal of Brindisi rejected a request for €15,000 in damages filed by a woman who fell near piazza Lama in Oria in March 2024. The judge determined her own imprudent behaviour broke the causal link to the alleged municipal fault and ordered her to pay more than €3,000 in legal costs.

The Tribunal of Bologna, in sentence No. 3582 dated 12 December 2025, ruled that a dental patient who paid a €14,000 deposit for prosthetic work could claim reimbursement of the deposit and compensation for the faulty treatment. The court recognized damages for persistent functional and aesthetic problems, the cost of removing the prostheses, moral and biological injury, and legal expenses.
