Italian courts deny compensation in child injury and stomach surgery cases

The Tribunal of Rome rejected a claim for €20,523 filed by the parents of a four‑year‑old who suffered a fractured right clavicle, ruling that the injury had not been proven to occur at school and that the burden of proof lay with the family. The court also addressed the school's request for unpaid tuition and penalties.

In a separate ruling, the Court of Appeal of Bologna upheld a lower court’s decision to deny compensation to a Rimini woman who underwent a subtotal gastrectomy and cholecystectomy after signing a consent form that she later argued was insufficiently detailed. The appellate judges concluded that, given her long‑standing severe reflux disease and the medical information provided, the patient would have consented to the procedure even with clearer disclosure, and therefore the claim was dismissed.
