Italian courts issue rulings on milk quota credits and bankruptcy procedures

The Italian Council of State (Consiglio di Stato) addressed a legal dispute regarding the collection of milk quota credits in the Friuli-Venezia Giulia region. The case involved an appeal against a payment notice from the Agenzia delle entrate Riscossione totaling over 26,000 euros. The dispute centers on the legality of administrative sanctions and supplementary levies for the 2014/2015 campaign, following European Court of Justice rulings that declared certain Italian national compensation operations non-compliant with EU law.

Separately, the Italian Court of Cassation (Corte di Cassazione) ruled on the limits of judicial authorization in composition with creditors (concordato preventivo). The court determined that when a court authorizes an extraordinary administration act, such as a settlement regarding known supply defects, the resulting priority status (prededuzione) for claims does not automatically extend to compensation for hidden defects. Such claims must be specifically submitted to judicial control to qualify for priority status, as they involve liabilities not previously evaluated by the court.
