Italian courts outline CCTV and police filming rules

Italian law distinguishes between privacy compliance and evidentiary value when using video recordings. In condominiums, CCTV footage may be admitted in court if the installation follows GDPR requirements, owners inform passers by visible signs, and storage is limited to what is necessary. Even if the system is not perfectly compliant, courts can still consider footage as evidence under procedural rules, separate from data‑protection regulations.

Filming police actions in public spaces is generally permitted under Article 21 of the Constitution, the civil code and the GDPR, provided the recording does not intrude on private spaces or reveal personal data without justification. Publication of such material must respect dignity and data‑processing obligations, and recordings inside private homes, ambulances or restricted areas are prohibited.
