Italian courts rule on condominium fund and laundry‑line disputes

Two recent Italian court decisions have clarified owners' rights in condominium management. The Tribunal of Patti ruled that an assembly cannot establish a special works fund without clearly defining the specific repairs or improvements to be financed; such vague resolutions are void because owners cannot be charged for undefined projects. The judgment emphasises that the scope of a work must be detailed before allocating contributions and before hiring technical professionals.

In a separate case, the Tribunal of Venice ordered the immediate removal of a laundry‑line rope installed in a historic building’s inner courtyard. The court held that the rope occupied the aerial space above a common area, infringing on co‑owners’ right to unobstructed use, and that any alteration of common parts requires assembly approval and must respect the building’s architectural decorum. Both rulings reinforce the need for precise, authorized decisions when dealing with shared condominium spaces.
