Italian courts rule on teacher rankings and residential burglary laws

The Italian Court of Cassation has rejected an appeal from a teacher in Caserta regarding the scoring system used for school rankings. The teacher contested the evaluation of professional qualifications, claiming that errors in the scoring process led to lost employment opportunities. Previous rulings from the Tribunal of Santa Maria Capua Vetere and the Court of Appeal of Naples had already dismissed the claims due to a lack of specific evidence and precise legal arguments.

Separately, the Constitutional Court issued ruling no. 130 of 2026 concerning the prosecution of residential burglaries. The Court ruled that residential theft can remain prosecutable ex officio (d'ufficio), rather than requiring a formal complaint (querela) from the victim. The decision maintains that the legislature has discretion in criminal policy, noting that residential burglary carries a unique social danger because it violates the sanctity of the home, not just property rights. This upholds the current legal framework despite efforts in the Cartabia reform to extend complaint-based prosecution to reduce judicial workloads.
