Italian courts set rules on unpaid condo fees and tenant‑caused rental damage

The Tribunal of Messina ruled that responsibility for overdue condominium charges rests with the owner who held the apartment when the service was rendered, not with the owner at the time the bill is issued. Legal costs, however, follow the ownership present at the moment of the court's decision. The April 18 2026 order cites established case law confirming that the obligation arises when the service (e.g., porter, cleaning, elevator) is actually provided.

In a separate case, the civil court in Rimini ordered former tenants to pay more than €25,000 to the landlord after the property was found heavily damaged following an eviction for non‑payment. The judgment, based on a technical inspection report, awarded €17,000 in damages plus court expenses, citing photographs that showed the deterioration occurred during the tenants' four‑year occupancy.

Both rulings underline the legal obligations of owners and renters in Italy when services are unpaid or properties are damaged, offering clearer guidance for future disputes.
