Italian courts support drivers' right to access traffic‑camera evidence

The Veneto Regional Administrative Court (TAR) ruled in favor of a Verona resident who had been fined for using a bus lane. The court rejected the municipality’s blanket denial of a request for documents and clarified that a defensive right of access does not require a pending legal case, allowing the driver to obtain specific evidence such as photos of the infraction, the system’s technical documentation, and signage.

In Belluno, the Tribunal accepted the demands of the motorists’ association Altvelox to call witnesses, including the prefect, the regional road authority director and police officials, to examine the technical and administrative procedures behind the installation of an autovelox device. The hearing is set for 1 December 2026 and will assess whether the equipment complies with legal standards and whether the municipality’s actions respect citizens’ rights.

Both rulings underline a growing judicial scrutiny of automated traffic‑enforcement measures in Italy, emphasizing the need for transparency and procedural correctness when municipalities impose fines based on electronic monitoring.
