Italian courts uphold landfill remediation orders amid contamination lawsuits

The Regional Administrative Court (TAR) rejected a claim by the Nova brothers to cancel the remediation of an 85,000‑square‑metre former landfill in Vimodrone, confirming the municipality’s and the Metropolitan City’s right to enforce clean‑up under the PNRR funding scheme. The judgment cited past environmental inspections and affirmed that owners must bear the cost of restoring the site.

In a separate proceeding in Modena, a preliminary hearing on the contaminated landfill in Finale Emilia concluded with the admission of multiple civil parties, including local associations and the municipality. A new technical report on pollution levels has been submitted, and the judge has postponed the decision on whether to refer the corporate and former public‑official defendants to trial until 29 September.
