Italian Education Ministry Hit by Court Ruling and ATA Staff Appeal

The Lazio administrative court annulled the Ministry of Education's decision that had rejected the recognition of a specialization in inclusive education earned in 2022 by Caserta teacher Genesio Fascione at the University of San Jorge in Zaragoza. The judges said the Ministry did not adequately compare the foreign training with Italian requirements and cited EU case‑law that a foreign title must be examined for possible equivalence. The Ministry must reopen the assessment of the teacher’s qualification.

The ATA workers’ committee “Evoluzione ATA” has written to Minister Giuseppe Valditara asking that the new rules governing teacher temporary assignments (Ordinance No. 27/2026) be extended to non‑teaching support staff. The committee refers to a recent Salerno case in which candidates were excluded from later calls despite new vacancies and to a Cassation Court ruling that applicants not appointed in the first round cannot be permanently barred from subsequent opportunities. It seeks equal application of the reconvocation principle to ATA personnel.
