Nordi noted that the power to grant clemency rests solely with the President and that the minister’s initiative was a humanitarian gesture to address perceived disproportionality in the penalty and compensation.

He explained that the legal code is ambiguous on whether a minister can start the procedure ex officio, but cited authoritative doctrine supporting such authority. Nordi also referenced a separate case involving the death of a 42‑year‑old man who was handcuffed by police, rejecting the notion of a “penal shield” that would grant immunity to officers.
