Italian law on condominium liability and maintenance
Under Italian law, specifically Article 2051 of the Civil Code, condominiums are generally held responsible for damages caused by the things they guard, such as common stairs, hallways, and landings. This liability applies to accidents involving guests, such as slips or falls on stairs, unless the damage is caused by a fortuitous event or the victim's own negligence.
Legal precedents also address shared liability in cases of property damage, such as water infiltration. In instances where damage results from poor maintenance or obstructed drainage, responsibility can be shared between the condominium and specific residents. For example, if a resident has exclusive use of a terrace, they may face concurrent liability alongside the condominium for damages arising from that area.
