Italian law on holographic wills and family assistance
Under Italian law, the validity of a holographic will depends on the testator's mental capacity and their physical autonomy during the writing process. While family members may provide verbal assistance to help an elderly person translate their wishes into precise technical language, the document becomes null if a beneficiary physically guides the testator's hand or wrist.
Legal protections ensure that the substance of the testator's will is respected as long as they maintain the capacity to understand and intend their actions. Furthermore, the law protects certain relatives, such as spouses, children, and parents, through mandatory inheritance quotas known as 'legittima', which limit total testamentary freedom to prevent the exclusion of immediate family members.
