Sicily Gains EU Autonomy Recognition, Opens Path to Over‑de‑minimis Aid

Italy’s Consiglio di Giustizia Amministrativa (CGA) issued an opinion confirming that the Sicilian region satisfies the institutional and procedural autonomy criteria identified by the EU Court of Justice in the “Azores” case, and may also meet the financial‑autonomy requirement. The ruling allows Sicily to argue that certain regional measures, such as its employment‑support scheme, are not subject to the EU de minimis aid limits, provided they are financed exclusively with regional own‑source revenues.

Regional Economy assessor Alessandro Dagnino called the decision “a significant result with strong innovative impact,” noting that it “strengthens the region’s responsibility and enhances the tools available to support investment, employment and competitiveness.” Industrial leaders Luigi Rizzolo (Sicindustria) and Diego Bivona (Confindustria Sicilia) welcomed the opinion, saying it could give Sicilian firms a competitive edge and help disperse the de minimis ceiling.

The CGA highlighted that the measure must apply uniformly across the entire region and that the regional fund must be sourced only from its own tax or patrimonial revenues, without state or supranational transfers.
