Italian Revenue Agency and CNDCEC release biennial tax agreement guide
The National Council of Accountants (CNDCEC) and the Italian Revenue Agency (Agenzia delle Entrate) have released an operational guide regarding the biennial preventive tax agreement (concordato preventivo biennale) for the 2026-2027 period.
The guide covers both new participants and those renewing their agreement. It incorporates updates from Legislative Decree no. 148 of August 7, 2026, also known as the ‘Omnibus fiscal decree’. Key changes include new regulations on the causes for termination and forfeiture of the agreement, as well as rewards for taxpayers who choose to renew.
Under the updated rules, an agreement made without meeting the necessary requirements is considered ineffective, which is legally distinct from forfeiture occurring after a valid agreement has been established. To qualify, businesses and professionals subject to ISA must not have definitively assessed tax or social security debts, unless such debts are reduced below 5,000 euros by the deadline. The deadline to accept, correct, or revoke an agreement is October 31, 2026.
