Italian Supreme Court clarifies urban scaffolding tax rules
The Italian Supreme Court (Corte di Cassazione), through ordinance no. 15419/2026, has established new criteria for the application of the TOSAP tax, which governs the occupation of public spaces and areas.
The ruling clarifies that the mere physical presence of scaffolding on a sidewalk does not automatically trigger the tax. Instead, authorities must verify the actual impact of the structure on the public's ability to use the space. The court emphasized that taxation cannot be based on a purely formal assessment of a structure's presence but must consider whether the public land is concretely withdrawn from collective use.
In the specific case, a condominium challenged a municipal tax demand for scaffolding installed for building maintenance. The condominium argued that because the structure was positioned at a height allowing pedestrian passage, it did not effectively obstruct the sidewalk. The court's decision provides significant guidance for private construction sites and condominiums regarding how local taxes are calculated based on the surface area actually occupied rather than the theoretical projection of the entire structure.
