Italian Supreme Court rules on condo fees and family disputes

The Italian Supreme Court (Cassazione) clarified that condominium fees are to be collected from the property owner or the holder of a real right on the unit, not from a spouse who occupies the family home under a judicial assignment. The Court affirmed this in ordinance no. 13963/2026, rejecting a condominium administrator’s attempt to enforce fees against the assigned spouse.

In a separate decision, the Court ruled that routine arguments between a daughter‑in‑law and her mother‑in‑law do not automatically meet the threshold for the criminal offence of maltreatment under article 572 of the penal code. The judgment (sentenza n. 16575) emphasized that a systematic, oppressive conduct is required for a conviction, and therefore the earlier conviction was annulled pending a review of whether the disputed behaviours constitute true maltreatment.
