Italian Supreme Court rules on mobile phone radiofrequency disclosure

The Italian Supreme Court (Corte di Cassazione) has issued an ordinance regarding the potential risks of radiofrequency exposure from mobile phones. In the case of Monica Briganti against Apple Distribution International Ltd., the Third Civil Section annulled a previous decision from the Court of Appeal of Bologna and remanded the case for further proceedings.

The ruling focuses on the manufacturer's duty to inform consumers when scientific risks are plausible but not definitively proven. The Court stated that compliance with technical standards and CE marking does not automatically fulfill safety obligations. It emphasized the precautionary principle and the concept of “as low as reasonably achievable,” suggesting that scientific uncertainty should prompt preventive measures and informative transparency to allow users to reduce exposure.
