Italian Supreme Court upholds conviction over pet waste
The Italian Supreme Court (Corte di Cassazione) has upheld a conviction against a dog owner in Palermo for failing to prevent animal waste from falling onto a neighbor's balcony. Under Article 674 of the Penal Code, which punishes the ‘dangerous throwing or pouring of things,’ the court ruled that the crime can be committed through omission.
The incident involved dog urine repeatedly flowing over the edge of a balcony and onto the property below. Despite repeated reports to the building administrator and health authorities, the owner failed to take action to stop the occurrence. The court confirmed that when a resident allows such a situation to persist, it transitions from a private matter to a criminal offense.
